ON AMENDMENTS TO SOME LEGISLATIVE ACTS OF THE REPUBLIC OF DAGESTAN

Introduce into Article 15 of the Law of the Republic of Dagestan dated April 8, 2008 N 18 “On public positions of the Republic of Dagestan” (Collection of Legislation of the Republic of Dagestan, 2008, N 7, Art. 234; 2009, N 7, Art. 272; 2010, N 3, Art. 53; 2011, N 19, Art. 850; 2012, N 7, Art. 245; 2013, N 5, Art. 255; N 8, Art. 499; N 13, Art. 875; N 21, Art. 1408; N 23, Art. 1559; N 24, Art. 1624; 2014, N 5, Art. 198; N 9, Art. 502; N 18, Art. 1029; 2015, N 3, Art. 69; N 13 , article 772; "Dagestanskaya Pravda", 2015, October 15, N 427-428; December 31, N 570; 2016, May 11, N 106-118; December 8, N 373-375; 2017, October 5, N 288-289) the following changes:

1) in part 2:

a) paragraph one should be stated as follows:

"The monthly supplement to the pension of a person who holds a public position in the Republic of Dagestan, when he holds public positions in the Russian Federation, public positions in the Republic of Dagestan and public positions in other constituent entities of the Russian Federation from one year to three years, is set at 45 percent, from three to six years - 55 percent, from six to ten years - 75 percent, from ten to fifteen years - 85 percent, from fifteen years and more - 95 percent of the monthly monetary incentive for the corresponding public position of the Republic of Dagestan minus the amounts of a fixed payment to the old-age insurance pension established for him (disability) and increases in the fixed payment to the old-age insurance pension (disability).";

b) in paragraph two, the first sentence should be stated as follows: “The monthly supplement to the pension of a person holding a public position in the Republic of Dagestan is established at his choice for the public position of the Republic of Dagestan, filled on the day he reaches the age entitling him to an old-age insurance pension, provided for (giving the right to an old-age labor pension in accordance with the Federal Law "On Labor Pensions in the Russian Federation"), or for the last government position of the Republic of Dagestan, the powers for which were terminated (including early).";

c) in the second sentence of the second paragraph, after the word “Chapter”, add the word “(President)”, replace the words “monthly monetary reward” with the words “monthly monetary incentive”;

2) part 3 should be stated as follows:

"3. A person who has held a public position in the Republic of Dagestan, who at the same time has the right to a monthly supplement to the pension provided for by this Law, a long-service pension, a monthly lifelong allowance, a monthly supplement to the pension (monthly lifetime allowance), additional (lifetime) monthly financial support , other payments assigned and financed from federal budget allocations in accordance with federal laws, acts of the President of the Russian Federation, the Government of the Russian Federation and international treaties of the Russian Federation, which provide for the appointment and payment of pensions for long service, other payments in the manner and on the terms, established for federal government civil servants, as well as long service pensions, monthly supplements to pensions, other payments in accordance with the legislation of the Republic of Dagestan, the legislation of other constituent entities of the Russian Federation or acts of local government in connection with the filling of government positions in the Republic of Dagestan, government positions other subjects of the Russian Federation and municipal positions, or in connection with the state civil service of the Republic of Dagestan, the state civil service of other subjects of the Russian Federation or municipal service, a monthly supplement to the pension provided for by this Law, or one of the named payments at his choice, is established.";

3) in part 5, the first sentence should be stated as follows:

"5. Payment of a monthly supplement to the pension to a person holding a public position in the Republic of Dagestan is suspended during the period of his civil service in the Russian Federation, when filling a public position of the Russian Federation, a public position in the Republic of Dagestan, a public position in other subjects of the Russian Federation, a municipal position filled by on a permanent basis, positions in the municipal service, as well as during the period of work in interstate (intergovernmental) bodies created with the participation of the Russian Federation, in positions for which, in accordance with international treaties of the Russian Federation, the appointment and payment of pensions for length of service, other payments in accordance with the procedure and under the conditions provided for federal civil servants.";

4) in part 11 the words “monthly monetary reward” are replaced with the words “monthly monetary incentive”.

Paragraph of the second part 4 of Article 2 of the Law of the Republic of Dagestan of December 4, 2008 N 59 “On additional monthly material support for citizens for special services to the Republic of Dagestan” (Collection of Legislation of the Republic of Dagestan, 2008, N 23, Art. 976; 2009, N 13, Art. 631; N 19, Art. 899; 2010, N 3, Art. 53; 2013, N 24, Art. 1624; "Dagestanskaya Pravda", 2015, October 15, N 427-428) shall be stated in the following wording:

"For persons specified in paragraph 1 of part 2 of Article 1 of this Law and who do not receive an old-age (disability) insurance pension, when calculating additional material support from the total amount of additional monthly material support and insurance pension, determined in accordance with the legislation of the Republic of Dagestan, the amount of social pension specified in subparagraph 1 of paragraph 1 of Article 18 of the Federal Law "On State Pension Provision in the Russian Federation." .

Introduce into the Law of the Republic of Dagestan of October 11, 2010 N 55 “On pensions for length of service to persons holding positions in the state civil service of the Republic of Dagestan” (Collection of Legislation of the Republic of Dagestan, 2010, N 19, Art. 918; “Dagestanskaya Pravda”, 2015, October 15, N 427-428; 2016, December 8, N 373-375) the following changes:

1) part 3.1 of article 3 should be supplemented with the following sentence: “In this case, the long-service pension is established in accordance with part 4 of this article.”;

2) in article 4:

a) part 3 should be stated as follows:

"3. When determining the amount of a long-service pension in the manner established by part 1 of this article, the amounts of increases in the fixed payment to the old-age (disability) insurance pension attributable to disabled family members, as well as in connection with reaching the age of 80 years or the presence of disability of group I, as well as the amount of increases in the size of the fixed payment when assigning an old-age insurance pension for the first time (including ahead of schedule) after the emergence of the right to it, restoring the payment of the specified pension or assigning the specified pension again after refusing to receive the established one (including ahead of schedule) ) old-age insurance pension.";

b) add part 4 with the following content:

"4. The minimum amount of the long-service pension cannot be lower than the amount of the fixed payment to the old-age insurance pension established by Part 1 of Article 16 of the Federal Law "On Insurance Pensions." ;

3) in part 2 of Article 6, the words “2.8 official salary (0.8 monetary remuneration) established for a civil servant in the relevant period or saved in the relevant period in accordance with the legislation of the Republic of Dagestan” are replaced with the words “80 percent of the monthly salary for the relevant civil service positions";

4) in article 8:

a) in Part 4 of Article 8, replace the words “official salary” with the words “monthly salary”;

b) part 5 should be stated as follows:

"5. The amount of the long-service pension is not recalculated when the size of the old-age (disability) insurance pension, the fixed payment to the insurance pension and increases in the fixed payment to the insurance pension are changed in accordance with the legislation of the Russian Federation, with the exception of the minimum amount of the long-service pension." .

1. Retain for persons who held public positions in the Republic of Dagestan and resigned their powers before the day this Law entered into force, as well as for persons who continue to exercise their powers in public positions in the Republic of Dagestan after this day, who acquired the right before the day this Law entered into force for the appointment of an old-age (disability) insurance pension in accordance with the Federal Law "On Insurance Pensions" and having on this day the duration of execution of the said powers of at least one year, the right to establish the law of the Republic of Dagestan of April 8, 2008 No. 18 "On State positions of the Republic of Dagestan" monthly supplement to pension and determination of its size without taking into account the changes made by this Law.

2. If the amount of the monthly supplement to the pension and long-service pension, when recalculated in accordance with this Law, decreases compared to what was previously established, the monthly supplement to the pension and long-service pension are paid in the amount established before the entry into force of this Law.

"Dagestanskaya Pravda" is the legal heir of the Dagestan Russian-language press. Its historical roots go back to the first years of the twentieth century, when the first sign of regularly published press appeared in the arena of public life in Dagestan in the form of the Russian-language newspaper "Dagestan". "Dagestanskaya Pravda" has absorbed the best traditions of its predecessors: from "Dagestan" (1906) - the popularization of liberal ideas, from the newspapers "Dawn of Dagestan" and "Muslim Newspaper", published by Said Gabiev in St. Petersburg in 1912-1914 , - rebellious spirit and the struggle for the enlightenment of the people, from "Dagestan worker" (1918) - revolutionary aspiration for the future, from "Red Dagestan" (1922-1931) - activity in the construction of socialism.

In Soviet times, the Dagestan regional party committee, establishing the Milestones of the history of a particular printed organ, proceeded from what revolutionary, Bolshevik, communist publications preceded it, recorded the moment of publication of the first issue of the first of them and, thus, built a bridge from modern newspapers and magazines to the era of revolution and the beginning of Soviet power. As for "Dagestanskaya Pravda", the predecessor, the beginning of it, was identified as the Bolshevik newspaper "Dagestan Worker", published in March 1918 under the leadership of Ullubiy Buynaksky and Ibrahim Aliyev (hence the current 85th anniversary of the newspaper).

During the period of democratic reforms, there is a reassessment of previous values, including in the field of journalism. As you know, at the beginning of 2003 the country celebrated the 300th anniversary of the Russian press, the history of which begins with the Vedomosti newspaper founded by Peter I (1703). FUNDAMENTALS OF PUBLIC ADMINISTRATION

In accordance with the changes made, the number of deputy ministers of agriculture and food of the Republic of Dagestan was increased from 5 to 6 units, including one first, one state secretary - deputy minister, three deputy ministers - heads of departments.

It has been established that the medium-term forecast is the basis for the formation of the republican budget of the Republic of Dagestan for the next financial year and for the planning period. When developing a medium-term forecast, data from the Territorial body of the Federal State Statistics Service for the Republic of Dagestan, other territorial bodies of federal executive authorities, executive authorities of the Republic of Dagestan, information provided by organizations operating in the territory of the Republic of Dagestan are used. A medium-term forecast is developed annually for the next financial year and for the planning period based on scenario conditions and the main parameters of the medium-term forecast of socio-economic development of the Russian Federation. In order to develop a medium-term forecast, the Ministry of Economy and Territorial Development of the Republic of Dagestan may create a working group. The medium-term forecast is subject to mandatory state registration in the federal state register of strategic planning documents.

Decree of the Government of the Republic of Dagestan dated 02/08/2010 N 30 “On approval of the Procedure for developing a forecast of socio-economic development of the Republic of Dagestan” has become invalid.

FINANCE. TAXES

The Procedure has been approved defining the conditions, goals and mechanism for providing subsidies to agricultural producers from the republican budget of the Republic of Dagestan, including funds received by the republican budget of the Republic of Dagestan from the federal budget, to support livestock breeding and increase the share of breeding livestock in the general herd. The purpose of providing subsidies is to support livestock breeding by reimbursing part of the costs of maintaining breeding stock of farm animals and breeding bulls assessed for the quality of their offspring or in the process of assessing this quality.

The procedure has been approved defining the conditions, goals and mechanism for providing subsidies to agricultural producers from the republican budget of the Republic of Dagestan, including funds received into the republican budget of the Republic of Dagestan from the federal budget, aimed at reimbursing part of the costs of increasing the breeding stock of sheep and goats, and the number of meat herd horses and commercial livestock of specialized beef breeds. Subsidies are provided for the purpose of developing sheep breeding, herd horse breeding and beef cattle breeding, and increasing livestock production in the Republic of Dagestan.

Subsidies to agricultural producers from the republican budget of the Republic of Dagestan, including funds received into the republican budget of the Republic of Dagestan from the federal budget, are provided in order to increase productivity in dairy cattle breeding, stimulate the production and processing of milk by reimbursing part of the costs per 1 kilogram of sold and (or) shipped for our own processing of cow and (or) goat milk.

Funds are provided to recipients of subsidies if the following conditions are met: carrying out production activities on the territory of the Republic of Dagestan; state registration and (or) tax registration on the territory of the Republic of Dagestan; the presence of current accounts opened by agricultural producers in institutions of the Central Bank of the Russian Federation or in credit institutions on the territory of the Russian Federation.

Decrees of the Government of the Republic of Dagestan dated March 19, 2013 N 135, dated June 13, 2013 N 307, dated September 5, 2014 N 413, dated April 28, 2015 N 125, dated August 17, 2015 N 242, dated October 15, 2015 No. 285, dated October 10, 2016 No. 294, dated February 14, 2017 No. 27 were declared invalid.

ECONOMIC ACTIVITIES

The approved Regulations determine the basic requirements for the procedure for catching and keeping animals entering the shelter for stray animals.

It has been established that stray animals are subject to capture in order to: prevent the occurrence and spread of epizootics, as well as diseases common to humans and animals; eliminating threats to human life and health, increasing the comfort of his life; ensuring public order and tranquility of the population; regulation of the number of stray animals; saving life and protecting human and animal health; providing assistance to animals in distress (sick, injured, in dangerous situations); returning a lost animal to its owner; transferring stray animals for maintenance to persons who have expressed a desire to accept them for further maintenance.

ENVIRONMENT AND NATURAL RESOURCES

In accordance with the amendments, it is established that the Ministry of Natural Resources of the Republic of Dagestan carries out, within its competence, regional state environmental supervision using a risk-based approach.

EDUCATION. SCIENTIFIC ACTIVITY. CULTURE

It was noted that in 2017, the number of registered participants in the Unified State Exam (hereinafter referred to as the Unified State Exam) in the Republic of Dagestan was 17,903 people, of which 13,604 were graduates of the current year, 3,120 were graduates of previous years, 1,095 were graduates who had not completed secondary (complete) general education. in previous years, 84 were students of secondary specialized education. To conduct the unified state exam, 75 examination points were used. The total number of points for conducting the main state exam in 2017 is 124. A comparative analysis of the main indicators based on the results of the Unified State Examination in the 2016/2017 academic year revealed a significant decrease in violations of the Procedure for conducting state final certification for educational programs of basic general education, both on the part of participants (significantly the number of remote participants and canceled works based on video marks has decreased) and on the part of the heads of examination sites and organizers. According to the results of the Unified State Examination in 2017, there was an increase in the number of high-scoring students - participants in the state final certification, who scored from 80 to 100 points, their number amounted to 2055 people.

It was determined that by September 1, 2017, the educational process will begin in 2,725 educational organizations, including: 802 preschool educational organizations with over 100 thousand children; 1,462 general education organizations, where more than 380 thousand students study; 39 institutions of higher professional education, where more than 70 thousand students are enrolled; 70 institutions of secondary vocational education with a contingent of 43 thousand students; 352 institutions of additional education for children, covering 211 thousand students; 4 organizations for orphans and children left without parental care, in which 189 children are raised. The weak material and technical base of educational organizations complicates quality preparation for the new academic year and the organization of the educational process. As of August 18, 2017, all 2,725 (100 percent) educational organizations were recognized as ready for the start of the school year. The work of the administrations of municipal districts and urban districts of the Republic of Dagestan to ensure the safety of educational organizations and compliance with fire and sanitary safety rules in them is insufficient.

Just like for Samur, in the same 2014, but already for Sulak, investment agreements were signed. In particular, a tripartite agreement between the Government of Dagestan, the Russian Industrial Investment Fund (RIIF) and the Vatan Corporation of Industrialists and Entrepreneurs on activities aimed at attracting investments in the hydropower sector promised investments of more than $2 billion.

But, alas, plans for the construction of small and medium-sized hydroelectric power stations and pumped storage power plants with a total capacity of up to 1 thousand MW, as well as the modernization of the energy transport system and housing construction, have so far remained only on paper. We, journalists, at least receive fees for our publications, but what about them, the initiators of investment projects? Expenses for foreign business trips and business meetings are one thing, but when a partner is ready to invest, but the republic is not ready to accept investments, this is very alarming. Dagestan's reputation is suffering significantly.

In this regard, of course, the emotions of the vice-president of the RPIF, the president of the Corporation of Industrialists and Entrepreneurs “Vatan”, the vice-president of the Guild of Builders of the North Caucasian Federal District Gadzhi Gadzhiev, which spilled out at a recent press conference at the RIA “Dagestan”, are understandable. His efforts to attract investors to the hydropower sector of Dagestan have been crashing like waves for ten years now - the republic has failed in the previous agreement. There are investors, but until the last day the doors of the government offices of Dagestan, despite all the declarations of great interest of their owners, were half-closed for them, as in the case of Gadzhiev.

According to Gadzhi Gadzhiev, the main reason for investment failures, in addition to the corruption component that has set the teeth on edge today, is the incompetence of people in power dealing with energy issues. How can an official supervising an industry resolve this or that problem if he does not know how power differs from voltage?! This is perhaps the only rhetorical question asked by Gadzhiev at the press conference. There were more expert calculations, based on which one of the main reasons for the plight of the energy complex of Dagestan is the republic’s lack of leverage over the industry, as well as the law and regulations that shape the investment attractiveness of renewable energy sources (RES).

First of all, according to experts, these are the existing rules of the game in the energy market, established after the division of the country's Unified Energy System and the creation of many intermediary companies. The situation is such that even the directors of hydroelectric power plants themselves today do not know about the cost of the energy generated at their hydroelectric power stations. Payment collection is handled by one company, networks by another, generation by a third, and only Moscow and Pyatigorsk know what is happening in these three “instances”.

Dagestan hydroelectric power stations also operate in the country’s energy market system to provide peak loads. For this reason, they are underproducing annually by 1 thousand MW of capacity of about 2.3 billion kW/h. electricity to average Russian characteristics. The volume of lost electricity from 2 thousand MW of capacity is up to 4 billion kW/h. Perhaps this is justified for the energy system of the South of Russia, but in this situation, Dagestan, according to energy experts, receives too little, which is not compensated by anything or anyone. First of all, the republican budget does not receive the electricity and taxes that Dagestan needs so much, and the environment suffers significantly. Frequent uneven water discharges at stations to provide peak loads due to the effect of flow turbulence have significantly expanded the floodplain of the Sulak River. For low-productivity, land-poor Dagestan, this is a serious loss. The Caspian Sea also suffers due to organic matter settling in reservoirs. Historical spawning grounds have been destroyed, sturgeon have nowhere to go to spawn, there is no food, and there is not enough water to pass through. And the siltation in reservoirs—strategic water resources—is prohibitive, and no one is concerned about cleaning them.

The President of the Association of Dagestan Energy Companies, Izamudin Dzhambulatov, spoke at a press conference about another, no less significant problem faced in connection with the liquidation of Dagenergo. We are talking about ownerless, so-called off-balance sheet networks, which were consolidated through the efforts of the Association, but never received the go-ahead for legal registration. The fact is that in a number of villages in Dagestan, in order to meet the needs of the population, substations, transformers, feeders and networks were built mainly by municipalities and business entities for many years. Now they are left without any maintenance, and this is up to 16% of Dagenergo’s former assets, currently estimated by experts to be up to 5 billion rubles.

Many of them are abandoned and neglected and, naturally, require technical rehabilitation.

Izamudin Dzhambulatov announced the figures for commercial losses of networks in Dagestan, which, according to open sources, amounted to 1.5 billion kW/h in 2015. Most of them are “commercial”, and this despite the fact that all stations in Dagestan generate an average of 4-4.5 billion kWh per year. At the present time, despite the fact that the Association was the initiator and did the work to consolidate these networks, there is a possibility of their gratuitous transfer to IDGCs, with which neither the Ministry of Energy, nor Gadzhi Gadzhiev and Izamudin Dzhambulatov categorically disagree.

The main argument of opponents of transferring them to IDGC is the protection of the interests of Dagestan, which, with the loss of these assets, will completely lose any influence on the energy market of the republic.

The participants of the press conference had plenty of proposals to give impetus to the development of the industry. In fact, this is a whole complex of projects in which investors are ready to invest, who have been waiting for the fifth year for an adequate attitude to the undertakings from the Government of the Republic of Dagestan.

The Russian Industrial Investment Fund, represented by President A. Bagnyuk, has repeatedly confirmed its intentions to invest in the development of the energy sector in Dagestan. In particular, this is the construction of small, decentralized hydroelectric power stations on the Avar Koisu and its tributaries. According to the first stage, investors intend to build 17 stations with a capacity of 15 to 25 MW/h; there are also a number of infrastructure projects. The republic only needs to create conditions for the effective development of projects and energy sales.

However, in addition to purely financial and organizational issues, the legal side of the undertaking remains unresolved. In order for small hydroelectric power stations to leave the generated energy locally, and not transport it to the country’s Unified Grid, the adoption of a republican law is required, which will allow decentralizing the supply of electricity to the consumer directly from generation, which will significantly reduce tariffs in mountainous areas. According to the initiators of the project, there is already a precedent for this in certain regions due to certain factors.

Developed countries have been increasing their Green Energy projects for 30 years. Launching the development of small-scale energy is the same as lighting a fire in the extinct fireplaces of the houses of the depopulated villages of mountainous Dagestan. The level of energy consumption in the mountains is lower than even in the backward countries of Africa. And we say – migration! Warm sheds, greenhouses and facilities, the effect on the processing industry, farming, powered by electricity from small hydroelectric power stations, renewable energy sources, can bring people back to the mountains. You just need to put your hands to it and have a professional attitude towards the energy resources given to Dagestan by the Almighty.
